Jury finds Daniel Leary guilty in motor vehicle homicide trial

Almost two and a half years after 29-year-old David Laduzenski was struck and killed by a pickup truck Daniel Leary was driving, a jury has found him guilty of motor vehicle homicide, while under the influence of alcohol and negligent driving.

"It's a sad day for two families, that's all I can say," said Ann Marie Laduzenski, David's mother.

"We're of course relieved to have this over. It's been two and a half years almost since this started, when my son was killed," said Donald Laduzenski, David's father. "And, it's kind of ironic that is the day that he was hit. The same day two years and four months ago."

Thursday afternoon the courtroom was packed with family and friends of both Leary and Laduzenski. And, as the verdict was read, sobs could be heard from loved ones on both sides of the isles.

Laduzenski was killed in March of 2011. The West Springfield native was at a friend's house, when he was struck. During the trial, prosecutors said Laduzenski was standing in the driveway when Leary swerved and hit him, while the defense had said that he was struck after running into the road.

Another significant disagreement in this case was whether or not Leary was impaired at the time of the crash.

Prosecutors say he had a blood alcohol level of .19, while the defense contends the test was wrongly administered.

This was Leary's second trial, as the first ended in a mistrial. 

"Justice has been done," said Ann Marie Laduzenski.

Members of the Leary family declined to comment after the verdict.

Sentencing is set for Monday morning at 11 a.m. Leary could face a minimum of two and a half years, and a maximum of 15 years in state prison.
