The 42-year-old Ashtabula man accused of crashing into an Amish buggy and killing one of the passengers pleaded not guilty in court on Tuesday.
Douglas Learn, 42, is charged with DUI, driving under suspension and aggravated vehicular homicide.
His bond was set at $75,000.
Sunday evening, an Amish buggy was traveling southbound on SR 168 in Geauga County when an SUV failed to stop within an assured clear distance ahead. The SUV struck the buggy and continued south on State Route 168. The explorer became disabled less than a mile from where the crash happened on State Route 700. The buggy was destroyed on impact.
The buggy was driven by Eli Byler, who refused treatment on scene. Four family members were inside the buggy at the time of the crash. Esther, 50, was treated and released. Irene, 23, was also treated and released. Alma, 19 was flown to Metro for precaution. And Joseph, 28, died at the hospital.
The Byler family tells 19 Action News that this is the second time the family buggy has been struck in the last four years.
