(Meredith) – Luke Armstrong, the 21-year-old son of famous cyclist Lance Armstrong, allegedly raped a 16-year-old girl at a party in 2018, according to an arrest affidavit.

Luke was arrested Tuesday and has since been released on bond, according to KXAN. He was charged with sexual assault of a child, a second-degree felony.

The alleged assault is said to have taken place in June 2018 when Luke was 18 and the girl was 16. An investigation began in November 2020 after the victim, now 19, reported the crime to police.

Luke’s legal team denies the allegation of a crime. In a statement to PEOPLE, attorney Randy Leavitt said the relationship between Luke and the girl was consensual, and he believes “a proper and thorough legal process will exonerate Luke.”

According to the affidavit, the victim said she attended a party and reached out to Luke to pick her up when she was ready to leave. The girl said she was intoxicated at the time and unable to recall the drive home from the party, but that she woke up on a couch in a location she did not recognize. She said she woke up to find Luke on top of her, and she couldn’t consent or fend him off as her raped her.

According to KXAN, during a phone call in December 2020, Luke admitted to having sex with the girl at his dad’s house in Austin, Texas.

Police said they spoke to several people who corroborated the victim’s story, including her mother, who said she noticed her daughter’s behavior change after that night. The mother also said her daughter suffered frequent nightmares following that night.

According to the Austin American-Statesman, the girl said she told six people about the alleged assault after it happened. Four of those people told police that they remembered the victim describing the sex as non-consensual.

A friend of Luke's who was with him the night of the alleged assault told police that Luke had not drank at all that night and was not intoxicated.

If convicted, Luke could face up to 20 years in prison, the Austin American-Statesman reported.
